These Terms and Conditions ("Terms") govern your access to and use of the Website www.ndjcolonisers.org and any services, information, or enquiries facilitated through it. By using this Website, you agree to these Terms in full. If you do not agree, please do not use this Website.

1. Definitions

Company refers to NDJ Colonisers Private Limited, registered under the Companies Act, 2013.
Website refers to www.ndjcolonisers.org and all subpages thereof.
User refers to any person accessing or using the Website.
Project refers to Ganesh Nagar residential township located at Village Lalpura, Nagar Palika Sambhar Lake, Tehsil Phulera, District Jaipur, Rajasthan.
RERA refers to the Real Estate (Regulation and Development) Act, 2016. RERA Registration Number: RAJ/P/2025/4590.

2. Eligibility

The Website is intended for use by persons who are at least 18 years of age and legally capable of entering into binding contracts under the Indian Contract Act, 1872. By using the Website, you represent that you meet these eligibility requirements.

3. Use of Website

You agree to use the Website solely for lawful purposes and in a manner that does not infringe the rights of any third party. You shall not:

Submission of an enquiry does not constitute a booking, reservation, or binding commitment from either party;
Any verbal or informal communication from sales staff shall not be construed as a legal offer unless confirmed in writing and supported by a registered agreement.

5. Bookings and Sale Agreements

Any booking of a plot in the Project shall only be valid upon:

Payment of the applicable booking amount as communicated by the Company;
Execution of a duly stamped and registered Agreement for Sale as required under RERA and applicable state laws;
Issuance of an official receipt or allotment letter by the Company.

The Company reserves the right to accept or reject any booking at its sole discretion without assigning any reason.

6. Pricing and Payment

All prices mentioned on the Website are indicative and subject to revision without notice. Final pricing will be confirmed in the Agreement for Sale. All payments must be made through lawful channels (NEFT/RTGS/cheque payable to NDJ Colonisers Private Limited). Cash payments shall be subject to applicable income tax laws. The Company shall not be responsible for payments made to any unauthorised persons.

7. Intellectual Property

All content on this Website, including logos, images, text, floor plans, site maps, and branding, is the exclusive intellectual property of NDJ Colonisers Private Limited or its licensors. No content may be reproduced, distributed, or used in any form without prior written consent of the Company.

8. Modification of Terms

The Company reserves the right to modify these Terms at any time. Updated Terms will be published on the Website with a revised effective date. Continued use of the Website after any such modification constitutes your acceptance of the updated Terms.

9. Termination of Access

The Company may, at its sole discretion and without notice, suspend or terminate your access to the Website if you are found to be in violation of these Terms or applicable laws.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its directors, employees, agents, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal costs) arising from your use of the Website or breach of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India. Any disputes arising hereunder shall first be attempted to be resolved through mutual negotiation. Failing resolution within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with a single arbitrator appointed by mutual consent. The seat of arbitration shall be Jaipur, Rajasthan. Courts in Jaipur shall have exclusive jurisdiction.

12. RERA Compliance and Consumer Rights

The Company is committed to compliance with the Real Estate (Regulation and Development) Act, 2016, and all rules and regulations framed thereunder. Buyers are entitled to all protections and rights provided under RERA. Any grievances may also be reported to the Rajasthan Real Estate Regulatory Authority at rera.rajasthan.gov.in.
